It's a warning that millions of vulnerable users are creating digital evidence trails that could destroy their lives.
The implications are staggering, and the regulatory response has been criminally slow. We're witnessing the creation of the world's largest mental health surveillance database, built one intimate conversation at a time, with zero legal protections and unlimited subpoena potential.

This regulatory vacuum creates perverse incentives. Companies can harvest mental health data without meaningful oversight, users receive unqualified "therapy" without professional safeguards, and the legal system treats intimate AI conversations as discoverable evidence rather than protected health information.

The company's privacy policy reads like a legal shield rather than user protection. Data can be shared with "specialized third-party contractors," retained for undefined "safety purposes," and accessed by "authorized employees" for "engineering support" and "legal compliance." Every exception creates potential exposure for users' most sensitive conversations.
The solution isn't to ban AI mental health applications—properly regulated, they could provide valuable support for underserved populations. But the current free-for-all approach is creating massive privacy violations and potential legal disasters for vulnerable users.
Congress must immediately extend attorney-client, doctor-patient, and therapist-patient privilege to AI mental health interactions. Users seeking emotional support shouldn't face different legal risks based on whether they talk to a human or artificial intelligence.
The FDA needs emergency guidance on AI mental health applications, establishing clear boundaries between entertainment chatbots and therapeutic tools. Companies marketing AI as therapy substitutes should face the same regulations as licensed mental health providers.
Until these protections exist, users must understand the risks. Every conversation with ChatGPT about personal problems creates discoverable evidence. Every interaction with AI therapy apps builds a psychological profile that could be subpoenaed. Every vulnerable moment shared with artificial intelligence becomes a potential legal weapon.
